Emerick was the son of Garret and Orphie Bennett and was one of their 10 to 12 children. In 1857, he married Lucia. He was a veteran of the Civil War having served with the 142nd Infantry Regiment, New York State Volunteers. He enlisted in Burke, NY, as a Private, on 8/25/1862; he was assigned to Company H, 142nd Infantry Regiment on 9/29/1862; he was promoted to full Corporal on 2/10/1863; and he was mustered out of the Army in New Berne, North Carolina, on 6/6/1865. Jefferson and Joshua were 2 of his siblings.
