On November 12, 1942, while leading his group on a flight to North Africa, his plane was shot down over Cherbourg. After the war his grave was found in Cherbourg. His remains were removed and interred in the Normandy American Cemetery.

He was the Great-Grandson of General Benjamin Alvord, USMA Class of 1833.
He was the son of Reginald Rutherford and Katharine Alvord Rutherford Spiller.
On September 15, 1938, he married Mary Austin Perry, daughter of Henry Austin Perry of Gonzales, Texas at San Antonio, Texas.
They were the parents of two children.
