LAST WILL AND TESTAMENT OF ALEXANDER LEE

In the name of the Benevolent Father of old, I, Alexander Lee, of Nottingham Township, Wells County, Indiana, do make and publish this my last will and testament.

Item 1. I give and devise to my son, William A. Lee, the following described real estate situated in Wells County, Indiana, to wit: Being the north east quarter of the south west quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres, more or less, in fee simple.

Item 2. I give and devise to my son, Alexander Lee Jr., the following described real estate situated in Wells County, Indiana, to wit: Being the south west quarter of the north west quarter of section five (5) township twenty-five (25) north, range twelve (12) east, containing forty (40) acres, more or less, in fee simple.

Item 3. I give and devise to my daughter Emily C. Collins, the following real estate situated in Wells County, to wit: Being the north west quarter of the south east quarter of section five (5) township twenty-five (25) north, range twelve (12) east, containing forty (40) acres more or less, in fee simple.

Item 4. I give and devise to my daughter, Louisa A. Sutton, the following real estate in Wells County, Indiana, to wit: Being the north east quarter of the north west quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres more or less, in fee simple.

Item 5. I give and devise to my daughter, Harriet A. Lane, the following real estate in Wells County, Indiana, to wit: Being the south east quarter of the north west quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres more or less, in fee simple.

Item 6. I give and devise to my daughter, Susan O. Gehrett, the following real estate in Wells County, Indiana, to wit: Being the north west quarter of the north west quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres, more or less, in fee simple.

Item 7. I give and devise to my son, John W. Lee, the following real estate in Wells County, Indiana, to wit: Being the south east quarter of the south west quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres, more or less, in fee simple.

Item 8. I give and devise to my daughter Clara M. Gerwig, the following real estate in Wells County, Indiana, to wit: Being the south west quarter of the north east quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres, more or less, for and during the period of her natural life, and at her death to go to her children.

Item 9. I give and bequest to the children of my deceased daughter, Nancy E. Wilson, to wit Fred Wilson and Laura Wilson, in lieu of any other interest they may have in my estate, the sum of $200.00 in cash, to be paid by my executor out of the funds of said estate.

Item 10. I have heretofore advanced to my daughter, Harriet A. Lane, the sum of $300.00 and to my daughter, Emily Caroline Collins, the sum of $150.00, said sums being in excess of any sums I have hereunto given to any of the children, and it is my desire that the advancements so made by me, to my said daughters, shall be taken into account by my executor in the settlement of my personal estate so that my children in the distribution thereof shall be placed on terms of absolute equality.

Item 11. I direct that my executor shall at the expense of my estate, inscribe my name on the tombstone I have heretofore erected to mark the last resting place of my deceased wife, Susannah Lee.

Item 12. It is my will and desire that all my personal property shall be sold by my executor and converted into money, and whatever may remain thereof, after paying all my just debts, and the bequest to my grandchildren, Fred Wilson and Laura Wilson, shall along with all the other assets of my personal estate and moneys, be equally divided among my children, William A. Lee, Alexander Lee Jr., Emily C. Collins, Louisa A. Sutton, Harriet A. Lane, Susan O. Gehrett, John W. Lee, and Clara M. Gerwig, after taking into consideration the advancements mentioned in Item No. 10.

Item 13. I do hereby nominate and appoint my son, Alexander Lee Jr. executor of this my last will and testament, hereby authorizing and empowering him to compromise, ? release and discharge, in such manner as he may deem proper, the debts and claims due me.

I do hereby revoke all former wills by me made. In testimony hereof I have hereunto set my hand and seal this 23rd day of May, in the year 1904.

CODICIL

I, Alexander Lee Sr., the undersigned, now of Wells County, State of Indiana, do now publish and declare this codicil to my will, which was made and duly executed by me on the 23rd day of May, 1904, and duly witnessed by Joseph S. Dailey and Abram Simmons.

Item 1. I revoke and cancel the gift and devise in Item number Seven (7) is my son John W. Lee and give, devise and bequest the following real estate as his interest as noted in Item number Seven (7) of my will, said real estate being described as follows: being the south east quarter of the south west quarter of section five (5), township twenty-five (25) north, range twelve (12), containing forty (40) acres of land, more or less, to vest in the said John W. Lee, at my death, for a period of natural life of said John W. Lee, and at the death of said John W. Lee that the remainder and the fee simple of the said described real estate in this item shall to vest in the heirs of said John W. Lee.

Item 2. I have hereunto loaned to the said William A. Lee, the sum of $125.00 for which I hold his note and I heretofore loaned to said Ralph Lee, son of William A. Lee, the sum of $40.00 upon which my son, William A. Lee, is surety. I desire that in the event the said note of $125.00 with interest has not been paid at my death and the said loan to Ralph Lee has not been paid, that the said notes shall be charged with interest at the rate of six per cent (6%) from late of said notes to the share of William A. Lee, in my personal estate. I heretofore paid as security for my son, William A. Lee, two notes the ? sums of which was respectively $100 each. I devise that these notes with interest and the ??? by these notes shall not be charged against any interest of my son, William A. Lee, in my personal estate.

Item 3. I desire that the devise and bequest as evidenced and stated in Item 6 of my will to my daughter, Susan O. Gehrett, that the said devise of real estate therein described shall be upon the following conditions: first that the said Susan O. Gehrett and her husband George Gehrett shall accept the said devise as full compensation for all claim and charges that they or either of them may have against my estate for care, board or maintenance of me prior to my death and in the event that Susan O. Gehrett or her husband, George Gehrett, shall bring any charge against my estate for board or maintenance of me or money advanced them or either of them for me prior to my death, then the bequest set out in this will to my daughter Susan O. Gehrett, shall be null and void; and I then direct that the executor of my estate shall sell the lands bequeathed in this will to Susan O. Gehrett and shall pay my daughter Susan O. Gehrett the sum of ($1600) sixteen hundred dollars, which said sum shall be her full and complete share in the whole of my estate and that if any remain that may be produced out of said sale shall be distributed among said heirs.

Item 4. I hereby republish and confirm said will in all other respects.

Done in the said City of Bluffton, Wells County, Indiana, this 19th day of December A.D. 1906.

Comes A.W. Hamilton and presents the Last Will and Testament of Alexander Lee Sr., deceased, for probate, and ? A.W. Hamilton of the subscribing witnesses to the Codicil of said last will and testament of Alexander Lee Sr., deceased, testified that he saw the said testator sign said codicil in his presence and in the presence of the other subscribed witness to said codicil, Mary Tribolet, and they both signed said codicil to his said will in the presence of said testator and in the presence of each other and that said testator was of sound and disposing and memory, and a resident of Wells Co. and over 21 years of age.

That said testator died in Wells County, Ind. February 24, 1907.

ALEXANDER LEE, OCTOGENARIAN DIED YESTERDAY.

Born in Virginia in 1824 and had lived on One Farm in This County Since 1854. Funeral Wednesday.

Alexander Lee, one of the oldest of the residents of the county died at
His home in Nottingham Township one mile from Poneto Sunday morning
at 6:15 after a week's suffering from pneumonia. He was aged 82
Years having been born in Virginia September 5, 1824. Funeral services
will be held at Poneto Methodist church at 10 o'clock Wednesday in
charge of Rev. Harter and interment will take place at the Grove cemetery.
Mr. Lee moved from his birthplace to Somerset, Ohio and after a short
residence there came to this county in 1854 and bought a farm in section
5, Nottingham Township where he resided to the time of his death.
Of eleven children there survive him Mrs. Harriet Lane, Mrs. Caroline
Collins, Mrs. Louisa Sutton, William A., John W., Alexander Jr., Mrs.
Carl Gerwig and Mrs. Ollie Garrett and a large number of grandchildren
And great grandchildren.

Her last name is on the death certificate of her son John W. Lee and the marriage record of Harriet to her second and third Husbands. She was born in Perry County, Ohio according to the national Funeral Register of her son John W. Lee and also her daughter Susan O. Gehrett. In an article on her son William A. Lee it states that she was born in 1828.

I know what is said about her maiden name being Tracy. There was a Susannah Tracy but here is what I did find---------
Peter, John's father, moved from Somerset Co., PA to Perry Co., OH sometime between 1810 and 1820. Do not know anything about the Tracy family except that her parents names were Philip and Susannah. This is really going to sound weird, John's older sister Susan Ansell was married to a Philip Tracy. This Philip must be a Jr. The only thing I know about this Susan is she died in Perry County, OH on 2/14/1855.
I found her buried in Wesley Cemetery, Perry County, Ohio. This proves this is not our Susannah.

Alexander lived on one farm since 1854 until his death. This farm is still standing. Grandma told us that all the woodwork and cabinets were hand made by Alexander Lee. The farm is in section 5 of Nottingham Township, Wells County, Indiana. Alexander was Superintend of the United Methodist Church of Poneto when the first report of the church was printed in 1881. He was also superintendent from 1883-34 and from 1890-1893. There is a stained glass window in the church that has an inscription Alexander Lee first Sunday School Superintendent of the Church. He and Susannah were early members of one of the earliest churches to be established, Prairie Church. This church was held in private homes in 1840. it was on the same circuit as Poneto the one they were members of the later. Alexander came to Indiana from Ohio around 1854.The Maiden name Tracy was said to be Susannah Ansel Lee's Nothing that I find has this in it. I have the marriage application and record. Ansel was Susannah name on both as well as the head stone.

LAST WILL AND TESTAMENT OF ALEXANDER LEE

In the name of the Benevolent Father of old, I, Alexander Lee, of Nottingham Township, Wells County, Indiana, do make and publish this my last will and testament.

Item 1. I give and devise to my son, William A. Lee, the following described real estate situated in Wells County, Indiana, to wit: Being the north east quarter of the south west quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres, more or less, in fee simple.

Item 2. I give and devise to my son, Alexander Lee Jr., the following described real estate situated in Wells County, Indiana, to wit: Being the south west quarter of the north west quarter of section five (5) township twenty-five (25) north, range twelve (12) east, containing forty (40) acres, more or less, in fee simple.

Item 3. I give and devise to my daughter Emily C. Collins, the following real estate situated in Wells County, to wit: Being the north west quarter of the south east quarter of section five (5) township twenty-five (25) north, range twelve (12) east, containing forty (40) acres more or less, in fee simple.

Item 4. I give and devise to my daughter, Louisa A. Sutton, the following real estate in Wells County, Indiana, to wit: Being the north east quarter of the north west quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres more or less, in fee simple.

Item 5. I give and devise to my daughter, Harriet A. Lane, the following real estate in Wells County, Indiana, to wit: Being the south east quarter of the north west quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres more or less, in fee simple.

Item 6. I give and devise to my daughter, Susan O. Gehrett, the following real estate in Wells County, Indiana, to wit: Being the north west quarter of the north west quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres, more or less, in fee simple.

Item 7. I give and devise to my son, John W. Lee, the following real estate in Wells County, Indiana, to wit: Being the south east quarter of the south west quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres, more or less, in fee simple.

Item 8. I give and devise to my daughter Clara M. Gerwig, the following real estate in Wells County, Indiana, to wit: Being the south west quarter of the north east quarter of section five (5) in township twenty-five (25) north, range twelve (12) east, containing forty (40) acres, more or less, for and during the period of her natural life, and at her death to go to her children.

Item 9. I give and bequest to the children of my deceased daughter, Nancy E. Wilson, to wit Fred Wilson and Laura Wilson, in lieu of any other interest they may have in my estate, the sum of $200.00 in cash, to be paid by my executor out of the funds of said estate.

Item 10. I have heretofore advanced to my daughter, Harriet A. Lane, the sum of $300.00 and to my daughter, Emily Caroline Collins, the sum of $150.00, said sums being in excess of any sums I have hereunto given to any of the children, and it is my desire that the advancements so made by me, to my said daughters, shall be taken into account by my executor in the settlement of my personal estate so that my children in the distribution thereof shall be placed on terms of absolute equality.

Item 11. I direct that my executor shall at the expense of my estate, inscribe my name on the tombstone I have heretofore erected to mark the last resting place of my deceased wife, Susannah Lee.

Item 12. It is my will and desire that all my personal property shall be sold by my executor and converted into money, and whatever may remain thereof, after paying all my just debts, and the bequest to my grandchildren, Fred Wilson and Laura Wilson, shall along with all the other assets of my personal estate and moneys, be equally divided among my children, William A. Lee, Alexander Lee Jr., Emily C. Collins, Louisa A. Sutton, Harriet A. Lane, Susan O. Gehrett, John W. Lee, and Clara M. Gerwig, after taking into consideration the advancements mentioned in Item No. 10.

Item 13. I do hereby nominate and appoint my son, Alexander Lee Jr. executor of this my last will and testament, hereby authorizing and empowering him to compromise, ? release and discharge, in such manner as he may deem proper, the debts and claims due me.

I do hereby revoke all former wills by me made. In testimony hereof I have hereunto set my hand and seal this 23rd day of May, in the year 1904.

CODICIL

I, Alexander Lee Sr., the undersigned, now of Wells County, State of Indiana, do now publish and declare this codicil to my will, which was made and duly executed by me on the 23rd day of May, 1904, and duly witnessed by Joseph S. Dailey and Abram Simmons.

Item 1. I revoke and cancel the gift and devise in Item number Seven (7) is my son John W. Lee and give, devise and bequest the following real estate as his interest as noted in Item number Seven (7) of my will, said real estate being described as follows: being the south east quarter of the south west quarter of section five (5), township twenty-five (25) north, range twelve (12), containing forty (40) acres of land, more or less, to vest in the said John W. Lee, at my death, for a period of natural life of said John W. Lee, and at the death of said John W. Lee that the remainder and the fee simple of the said described real estate in this item shall to vest in the heirs of said John W. Lee.

Item 2. I have hereunto loaned to the said William A. Lee, the sum of $125.00 for which I hold his note and I heretofore loaned to said Ralph Lee, son of William A. Lee, the sum of $40.00 upon which my son, William A. Lee, is surety. I desire that in the event the said note of $125.00 with interest has not been paid at my death and the said loan to Ralph Lee has not been paid, that the said notes shall be charged with interest at the rate of six per cent (6%) from late of said notes to the share of William A. Lee, in my personal estate. I heretofore paid as security for my son, William A. Lee, two notes the ? sums of which was respectively $100 each. I devise that these notes with interest and the ??? by these notes shall not be charged against any interest of my son, William A. Lee, in my personal estate.

Item 3. I desire that the devise and bequest as evidenced and stated in Item 6 of my will to my daughter, Susan O. Gehrett, that the said devise of real estate therein described shall be upon the following conditions: first that the said Susan O. Gehrett and her husband George Gehrett shall accept the said devise as full compensation for all claim and charges that they or either of them may have against my estate for care, board or maintenance of me prior to my death and in the event that Susan O. Gehrett or her husband, George Gehrett, shall bring any charge against my estate for board or maintenance of me or money advanced them or either of them for me prior to my death, then the bequest set out in this will to my daughter Susan O. Gehrett, shall be null and void; and I then direct that the executor of my estate shall sell the lands bequeathed in this will to Susan O. Gehrett and shall pay my daughter Susan O. Gehrett the sum of ($1600) sixteen hundred dollars, which said sum shall be her full and complete share in the whole of my estate and that if any remain that may be produced out of said sale shall be distributed among said heirs.

Item 4. I hereby republish and confirm said will in all other respects.

Done in the said City of Bluffton, Wells County, Indiana, this 19th day of December A.D. 1906.

Hamilton of the subscribing witnesses to the Codicil of said last will and testament of Alexander Lee Sr., deceased, testified that he saw the said testator sign said codicil in his presence and in the presence of the other subscribed witness to said codicil, Mary Tribolet, and they both signed said codicil to his said will in the presence of said testator and in the presence of each other and that said testator was of sound and disposing and memory, and a resident of Wells Co. and over 21 years of age.

That said testator died in Wells County, Ind. February 24, 1907.

ALEXANDER LEE, OCTOGENARIAN DIED YESTERDAY.

Born in Virginia in 1824 and had lived on One Farm in This County Since 1854. Funeral Wednesday.

Alexander Lee, one of the oldest of the residents of the county died at
His home in Nottingham Township one mile from Poneto Sunday morning
at 6:15 after a week's suffering from pneumonia. He was aged 82
Years having been born in Virginia September 5, 1824. Funeral services
will be held at Poneto Methodist church at 10 o'clock Wednesday in
charge of Rev. Harter and interment will take place at the Grove cemetery.
Mr. Lee moved from his birthplace to Somerset, Ohio and after a short
residence there came to this county in 1854 and bought a farm in section
5, Nottingham Township where he resided to the time of his death.
Of eleven children there survive him Mrs. Harriet Lane, Mrs. Caroline
Collins, Mrs. Louisa Sutton, William A., John W., Alexander Jr., Mrs.
Carl Gerwig and Mrs. Ollie Garrett and a large number of grandchildren
And great grandchildren.

Her last name is on the death certificate of her son John W. Lee and the marriage record of Harriet to her second and third Husbands. She was born in Perry County, Ohio according to the national Funeral Register of her son John W. Lee and also her daughter Susan O. Gehrett. In an article on her son William A. Lee it states that she was born in 1828.

I know what is said about her maiden name being Tracy. There was a Susannah Tracy but here is what I did find---------
Peter, John's father, moved from Somerset Co., PA to Perry Co., OH sometime between 1810 and 1820. Do not know anything about the Tracy family except that her parents names were Philip and Susannah. This is really going to sound weird, John's older sister Susan Ansell was married to a Philip Tracy. This Philip must be a Jr. The only thing I know about this Susan is she died in Perry County, OH on 2/14/1855.
I found her buried in Wesley Cemetery, Perry County, Ohio. This proves this is not our Susannah.

Alexander lived on one farm since 1854 until his death. This farm is still standing. Grandma told us that all the woodwork and cabinets were hand made by Alexander Lee. The farm is in section 5 of Nottingham Township, Wells County, Indiana. Alexander was Superintend of the United Methodist Church of Poneto when the first report of the church was printed in 1881. He was also superintendent from 1883-34 and from 1890-1893. There is a stained glass window in the church that has an inscription Alexander Lee first Sunday School Superintendent of the Church. He and Susannah were early members of one of the earliest churches to be established, Prairie Church. This church was held in private homes in 1840. it was on the same circuit as Poneto the one they were members of the later. Alexander came to Indiana from Ohio around 1854.The Maiden name Tracy was said to be Susannah Ansel Lee's Nothing that I find has this in it. I have the marriage application and record. Ansel was Susannah name on both as well as the head stone.
