Nicholas enlisted in the Confederate States Army on 10 October 1863 in Camden, Alabama. He was mustered as a Private in Company F, 21st Alabama Infantry. He was admitted to Ross Hospital in Mobile, Alabama on 19 June 1864 with Dysenteria (febris thphoids) known as typhoid fever. On 20 June 1864 he was sent to the General Hospital and died on 13 July 1864.

Son of William Gurley (b.1786 NC) and (name of mother unknown). He married Nancy Morgan (b.1827 AL and d.c1865). From this union they had the following known children: Mary Eliza (b.1852), Susan Carlene (1853–1927), Ann (1855–1865), Barba (b.1857). A Will, probated on 28 April 1866 in Wilcox County, Alabama in which it listed minor children and cited property of N.H. Gurley.
