Eugene Davis "Gene" Maxwell was the son of Riley Newton Maxwell and Sarah Frances Mitchell. His father was a farmer and property owner in Jackson County, GA. His grandfather was William Maxwell and his great grandfather was Rev. Thomas Maxwell, the Revolutionary War veteran and early American baptist pastor of Banks County, GA who was jailed and persecuted and defended by Patrick Henry. His grandmother Jane Higginbotham Maxwell, William's wife, was the daughter of Revolutionary War veteran Jacob Higginbotham of Banks County, GA.

He married Callie Fornie Smith on Dec. 28, 1881. They lived in Hall County, GA and were very active in the Methodist Church. He was a farmer. Later in his life, census records show that she was the matron of a boarding school.

They had the following children:

One of their many fine children, Alva Maxwell, was well-known as vice-president of Citizens and Southern National Bank of Atlanta. There is a building at Young Harris College named after Alva and Edna Maxwell.
