James was the 3rd child of Peter & Jane (Sherman) Rutan's ten children. He married Amelia Brees (several spellings) Nov 13 1861, probably in Chemung County, New York. He was a cabinet maker and carpenter.
They had seven children.
He served in the Civil War in Co A, 179th Regiment, New York Infantry.
Following the war, where he received an injury during the "Battle of the Crater" near Petersburg, Virginia, he returned to Horseheads, where he worked as a carpenter. They moved west after the birth of their son Frederick. They lived 1st in Minnesota and in Omaha, Nebraska in 1870. The returned to Elmira, New York before 1872.
