A surgeon has been accused of malpractice after an autopsy revealed that the cause of death of an Australian woman during cosmetic surgery in March was a punctured lung and not a pulmonary embolism as was first indicated.

Evita Nicole Sarmonikas, 29, died on the operating table March 20 at a clinic in Mexicali, Baja California, while undergoing a "Brazilian butt lift," or liposuction.

Sarmonikas' family was advised by the Quirúrgico del Valle del Centro that the young woman had died of a heart attack and it would have the body cremated and the ashes sent to Australia.

But her sister, Andrea Sarmonikas, insisted that cremation not take place and flew to Mexico to determine what happened. After a first autopsy found the cause of death was a nonthrombotic pulmonary embolism, Andrea Sarmonikas ordered a second, private autopsy by specialists in forensic medicine. Their findings were not the same.

The right lung had been perforated more than four times by "an instrument," Sarmonikas said in a report published by the Gold Coast Bulletin.

"Contrary to what was ruled by the doctor of the Attorney General of the state of Baja California, the second autopsy determined that my sister was perforated on more than four occasions in the right lung, causing a hemorrhage that led to her death.

"Evita did not die from a pulmonary embolism nonthrombotic as we were first advised (and) we have now lodged the report of the second autopsy through the proper criminal procedures."

She declined to give more details about the instrument that caused the punctures for legal reasons.

At a press conference this week, Sarmonikas accused Dr. Víctor Manuel Ramírez Hernández of malpractice and alleged he did not have the necessary certification to carry out the procedure.

She charged that another patient of Ramírez died a year ago following surgery and revealed there were two more cases in which his patients had suffered severe side effects after cosmetic procedures.

Sarmonikas said the surgeon must take responsibility for her sister's death and that further loss of life be prevented.

"It has become clear that I will not leave Mexico until the individuals who participated in the surgery that caused my sister's death take full responsibility," she said.

"I will never be able to fill the huge gap that is left in the heart of my mother, in the heart of our community and in mine but we can, and we will, work to ensure Evita's death is not in vain."

Her lawyer, Israel Agua Rueda, called on authorities to investigate and get to the truth of what happened.

The clinic was reported to have closed and the surgeon suspended.
