NICKNAME "BILLY"

WILLIAM RAY AUER, 9 years old of Toledo was killed July 5th shortly before 5:00 p.m. at the Oak Street Overpass of the NewYork Central Railroad tracks in Eastern Toledo.

A railroad watchman was not successful in stopping a Military troop train after a passerby shouted that a boy's body was lying motionless on the railroad tracks.

The child was rushed to the East Side Toledo Hospital by police but he was dead on arrival. His same playmate friend said they had been hunting for birds nests on the bridge trestle when he fell below.

BILLY WAS THE SON OF PARENTS
Esther M. Auer of Toledo, Ohio; formerly Esther Margaret Belman of Riga, MI and Carl W. Auer of Sylvania, Ohio.
He was a
3rd Grade student and attended Hathaway Elementary School in Toledo.

SURVIVORS include his mother Esther M. Belman- Auer and father Carl W. Auer of Toledo; his two Sisters Ardis M. Auer-Crockett and Grace J. Auer;
Aunts Lelah Belman all of Ohio.

1939-He was a first-time Uncle at age "four" to David Thomas C, 1939 and Carol Ann Crockett year 1941.

Sisters: Ardis Margaret Auer-Crockett (age 22) of East Chicago, Indiana; and Grace June Auer (age 14) of Toledo, Ohio.

HIS BODY was transported and being cared for by his loving Uncle Albert Belman at his Owned and Operated Belman-Mann Funeral Home in Riga, Michigan.

FUNERAL SERVICE
Will be solemnly held at the Belman-Mann Funeral Home July 8 at 2:30 p.m. Officiated by the Rev Herbert Brubaker.

Followed by an immediate Burial conducted by the Riga Cemetery in Riga Michigan.

A PRECIOUS YOUNG SPIRITED LIFE SUDDENLY PERISHED...

Billy was born at home on Clover Lane in Trilby, Ohio June 2, 1939-He lived a very short life due to a horrific accident that ensued while playing with a friend, fallen from above and onto the R.R. tracks on this day, July 5, 1944.

It was never determined if he initially first died due to his fall or of his certain death by the train.

It was apparent that the flagman totally failed to stop the train or remove his body from the tracks.

That being said, it was obvious he was run over by the train. However, enough time lapsed to have him removed possibly saving his life.
Zero evidence remained pertaining to total injuries he had sustained just from the fall.

Several years passed and the family became more agitated and emotionally traumatized waiting for the Ohio Supreme Court to bring their case to Court for Charges of: "Negligence," due to total Disregard for the young male found lying helplessly on the train tracks of the New York RailRoad by their watchman on duty.

More additional severe charges included: "Callous Disregard of the obvious Consequences, and Wrongful Death."
This was a trial by jury that forever lingered, but was finally settled July 28, 1948, four years later. Lawsuit trial closed with a disgusting judgement award of under $4,500.. for wrongful death!

Unbelievable! This was a mere case of a giant, and a very powerful company whereby money talks; the system found and realized Billy's parents were both of severe low income and by fighting time and the powerful reality seems always to win!
