ANN KATHRYN KERWIN, 6, born April 7, 1997 in Dallas who left this earth too soon on October 15, 2003.

She was a sweet, precious girl who will be greatly missed by her father and mother, Colin and Barbara Kerwin and her little sister and best friend, Erin.

She loved puzzles, kittens, and her Pooh. She enjoyed her new school, University Park Elementary and loved going on campouts with her Y-Princess tribe. She looked like her mom when she was a young girl and every night since she was two she slept with one of her dad's old rugby shirts.

She is survived by both sets of grandparents and numerous aunts, uncles and cousins.

A Mass of the Angels will be celebrated Saturday, October 18, 2003, at 10 a.m. at Christ the King Catholic Church, 8017 Preston Rd., Dallas.

The family asks the memorials be made to the University Park Civic Foundation on behalf of Elanas Childrens Memorial Park, 3800 University Blvd., University Park, Texas 75205, 214.363.1644, in honor of Ann Kathryn.

A Dallas County grand jury will decide whether to file criminal charges against the driver of a pickup that struck and killed a 6-year-old girl crossing the street on her way to school, police said Thursday.

First-grader Ann Kathryn Kerwin died Wednesday morning after being struck while crossing Hillcrest Avenue on her way to University Park Elementary School.

Her mother and 4-year-old sister were crossing the intersection with her and were not injured.

University Park police Lt. Ray Lacy, the department's spokesman, said the standard protocol is to refer all cases involving a death to a grand jury.

No charges have been filed against the driver, Charles Austin Ames, 18. He was turning left onto Hillcrest Avenue from Purdue Street when his pickup struck Ann. She died at Children's Medical Center.

The Kerwin family declined to comment Thursday. A neighbor who answered the family's phone called the accident "a sad tragedy all the way around."
Dan Garrigan, the Ames family's attorney, said it's too early to tell what might happen.

"Certainly, we're hopeful that the grand jury would review all the facts here and come to the conclusion that this was a tragic accident and not something that requires prosecution," Mr. Garrigan said.

Services for Ann Kerwin were held at 10 a.m. Saturday at Christ the King Catholic Church.

Oh to see his face, at the joy he now has. For once on earth she wondered, a happy and curious child with thoughts so pure and innocent. A heart so tender and mild, now safe at home, with her father she will be. Oh to see his happy face what a sight to see!
